Before your visit
Participant Agreement, Assumption of Risk and Release
Every adult who will work during a visit reads and signs this once. It covers this visit and any visit in the next 12 months. A parent or guardian signs for anyone under 18.
Thirty Mighty Men Ministries ("30MMM"), a 501(c)(3) nonprofit, runs I Did That!, a home-project coaching program, through The Carpenter's Son. In this agreement, "we" and "us" mean 30MMM and The Carpenter's Son. "You" means the person signing.
-
We coach. You do the work.
We provide instruction and coaching. Your coach explains and demonstrates, then watches and advises while you do the work yourself. We are not hired to perform, finish or guarantee any project. Your coach may do a step himself only to show you how, or to make a situation safe.
-
Your project, your decisions
You choose the work and you do it. You are responsible for:
- buying materials and parts suited to the job;
- any permission you need from a landlord, HOA or condo board;
- any permit or inspection the work requires;
- the finished work, and for your vehicle, its safe condition before you drive it.
After any brake work, you agree to test the brakes at walking speed before driving normally. You may choose to have any car work checked by a licensed mechanic, and we encourage it.
-
The risks
Home and car projects carry real risks, even when everyone is careful. They include cuts and punctures, burns, electric shock, eye injuries, falls, strains, crush injuries from vehicles or heavy objects, contact with hot fluids or battery acid, breathing dust, fumes or chemicals, fire, water leaks and damage to your home, vehicle or belongings. Older homes and cars can hide problems such as lead paint, asbestos, mold, worn wiring or rusted parts.
-
Safety rules
- Wear the safety gear your coach asks for, including eye protection.
- Follow your coach's instructions. Turn off power, water or the engine when told.
- No alcohol or drugs before or during a visit.
- Tell your coach about any health condition that affects your safety.
- Your coach may pause or stop any task at any time for safety.
-
When we find a bigger problem
If a task turns out to be unsafe or outside what we coach, such as suspected lead paint in a home built before 1978, asbestos, mold, damaged wiring or a leaking gas line, we will stop that task and recommend a licensed professional.
-
Children
Anyone under 18 takes part only with their parent or guardian present and supervising them the whole time. The parent or guardian signs this agreement for them and is responsible for them during the visit.
-
Apprentices
Apprentices are trainees in our program. They are not your employees or contractors. You pay any apprentice program fee to us, and we pay apprentices a training stipend. Apprentices work under your coach's direction.
-
Tools, property and insurance
Tools we bring remain ours. Use them only as your coach shows you. Before the visit, please clear the work area, protect floors and valuables, and secure pets. You keep responsibility for insuring your home, belongings and vehicle. We suggest checking your homeowner's, renter's and auto policies.
-
No warranty on the work
Because you perform the work, we make no promise or warranty about the result. Any warranty on parts is between you and the maker. Some makers require professional installation to keep their warranty.
-
Assumption of risk
I have read the risks above. I understand them, and I choose to take part and accept them.
-
Release
To the fullest extent the law allows, I release and agree not to sue 30MMM, The Carpenter's Son, and their directors, officers, staff, coaches, volunteers and apprentices (the "Released Parties") for any injury, illness, death, or loss of or damage to property that arises from the coaching or from work I do, including claims based on the ordinary negligence of a Released Party. This release does not cover gross negligence, willful misconduct, or anything the law does not allow to be released.
-
Claims by others
I agree to cover the Released Parties' reasonable costs, including attorney's fees, for claims brought by other people that arise from work I do or direct at my property or on my vehicle, except to the extent a claim is caused by a Released Party's gross negligence or willful misconduct.
-
Emergencies
If someone is hurt, your coach may call 911 and give first aid. I agree to get emergency care if needed, at my own cost.
-
General terms
The law of the place where the coaching happens governs this agreement. If a court finds any part of it unenforceable, that part is limited as the law requires and the rest still applies. This is the whole agreement about these risks. My typed name below is my signature.
